What To Expect From a Workers Compensation Claim

Injured at Work Attorney

If you have been injured at work, you may be wondering what you should expect from this point forward. The process can be confusing and difficult, especially if you are dealing with a serious injury that needs immediate medical assistance. Initially, your employer will be required to complete an accident or incident report detailing how the accident happened and listing the body parts that were injured. Unfortunately, many employers may avoid this process in the hopes that you do not follow through and proceed with bringing a workers compensation claim. If this occurs, it is likely a good time to hire an attorney.

At the Law Offices of Ala Alikhani, P.A., we will file a Petition for Benefits with the Court and we will seek the benefits that you may be entitled to receive under the law. The first step in the process will be to have an evaluation performed by a physician. Once the Petition for Benefits has been filed, the Employer and their insurance carrier (Employer/Carrier) has 30 days by law to respond to it indicating whether the claim will be picked up or denied. If the claim is picked up by the insurance company, a clinic will generally be authorized as the first point of medical treatment. The Employer/Carrier will select the clinic from within their network of authorized providers and the selection of the clinic will also be up to them.

From that point forward, the treatment that is recommended and the work restrictions that the doctor places you on will determine how the case proceeds and where it’s headed. Any time any form of treatment is recommended by an authorized doctor, we will file a Petition for Benefits to speed up the process of having that specific benefit authorized by the Employer/Carrier. If that benefit is denied or disputed in any way by the Employer/Carrier, we will then look into litigating that issue and will fight on your behalf to obtain it.

Furthermore, if the authorized physician takes you out of work or places you on light duty restrictions and your employer does not offer work within those restrictions, then we will reach out the insurance carrier regarding wages that you may be entitled to.

Unfortunately, it can be a difficult process dealing with employers and their insurance companies when you have been injured at work. At the Law Offices of Ala Alikhani, P.A., we strive to have that process move along as smoothly as possible.

When you hire the Law Offices of Ala Alikhani, P.A. to represent you, we go to extremes to ensure employers and their insurance companies are held accountable and that you receive the benefits that you are entitled to by the law.
